This applies whether you leave in a friend’s or family member’s car because your car has been towed to the garage, or whether you are able to drive your own car home. The first thing to make sure you have is the other driver’s contact and insurance information. A simple way to ensure you have this information is to take a picture of (i) his or her driver’s license and (ii) his or her insurance card with your phone. You also need to get the contact information (name, address, and phone number) of any witnesses to the accident so you can put them in touch with your lawyer later. Again, recording this information on your phone is a handy way to do this.
Get the Police Report, but Don't Rely Solely on That

Even though the police report is not admissible in evidence in a civil lawsuit involving a motor vehicle accident, it can nevertheless be an important tool in settlement negotiations with the insurer for the negligent driver, as it contains the impressions of an experienced police officer about what happened and whose fault it was. Therefore, having a copy of that document is essential; you need to make sure you leave the accident scene with it. However, as discussed above, don’t assume everything you need will be in there; instead, make sure you independently secure all the information you can and don’t rely on the police officer to do so.
